### What is a cannabis social club?

A cannabis social club (CSC) is a private, non-profit association. Members grow cannabis collectively and share it among themselves for personal use, a model Spanish case law tolerates for closed, members-only cultivation and consumption. Clubs are not shops: nothing is sold to the public, and membership is never open to tourists walking in off the street.

### How to join a club

Joining typically means three steps: submit a membership application directly to the club, provide identification confirming you are a legal-age Spanish or EU resident, and attend an in-person interview at the club. Most clubs also ask for a personal recommendation from an existing member, and approval can take anywhere from a few days to a few weeks.

**Cannabis is not legal in Spain, and it is not simply illegal either.** Before you look for a cannabis social club in Málaga or anywhere along the Costa del Sol, it is worth knowing where Spanish law actually draws its line — because it is not where most visitors assume. Law stated as at 21 August 2026.

## What Spanish law protects, and what it does not

**An adult may consume and possess cannabis in a private place. That is decriminalised, not legalised** — there is no offence, but there is also no right, and there is no lawful way to buy any. Article 368 of the Código Penal still punishes supply, and for cannabis the ordinary sentencing range is one to three years.

The distinction matters more here than almost anywhere in Spain, because the Costa del Sol runs on visitors who arrive carrying a mental model imported from Amsterdam or from a legal American state. Neither of them describes Andalucía.

## Registration does not make a club legal

**Nearly every association in Málaga province appears in the Registro de Asociaciones de Andalucía under Ley 4/2006, and that entry proves far less than the framed certificate suggests.** Registration is declarative, not constitutive: it records that an association exists and publishes its statutes. It confers nothing at all on cannabis activity, and no registrar has ever examined the cannabis side of what a club does.

Andalucía has never regulated cannabis associations, and since the Constitutional Court struck down Navarra's law in STC 144/2017 and Catalonia's in STC 100/2018, no autonomous community may. Only the Cortes Generales could, and they have not.

## What actually gets a club closed here

**In February 2025 the investigation unit of Málaga's Policía Local, working with the Policía Nacional, closed four cannabis associations in the city and charged eight people.** The failings named were mundane and instructive: member access that was not restricted at all, missing documentation, no liability insurance, and consumption on the premises. One of the four was already subject to a cease order.

In August 2026 the Policía Nacional dismantled what it described as a coffee shop in the centre of Marbella, arresting five. The pattern along this coast is consistent: what draws enforcement is a club behaving like a shop.

## The Supreme Court closed the argument clubs used to make

**The shared-cultivation defence is gone.** In STS 484/2015 the Supreme Court, sitting in plenary, held that organised cultivation and distribution with a vocation of permanence, open to new members, is trafficking under article 368 — not the shared private consumption the doctrine was built for. It has restated that position ever since, most recently in STS 328/2025, which added the separate offence of unlawful association.

A membership fee does not change the analysis. Where the payment scales with the quantity taken away and the association exercises no control over what happens next, the courts read it as a sale wearing a subscription's clothes.

## Waiting periods and invitations — what they are actually worth

**You will be told that an existing member must endorse you, and that a waiting period applies before you may collect anything. No Spanish law requires either.** Both come from the associations' own code of good practice. They are risk management rather than compliance: a club that skips them is not breaking a rule that exists, and a club that applies them is not thereby made lawful. Treat them as a signal about how carefully a place is run, not as proof of anything.

## Outside the door, the rules change completely

**Consuming or carrying cannabis in a street, on a beach, on a bar terrace or on a bus is a grave administrative infraction under article 36.16 of Ley Orgánica 4/2015, and the grave band runs from €601 to €30,000.** It applies whether or not the cannabis was ever destined for anyone else. Torremolinos, Benalmádena, Fuengirola, Estepona, Nerja and Marbella all enforce it, and a membership card is not a defence one step beyond the association's own door. Can I buy cannabis at a cannabis social club?

No. Clubs never sell cannabis to the public or to non-members. Membership only permits collective, closed-circuit cultivation and consumption among existing members.

Membership requires identification and, in practice, Spanish or EU residency. Clubs do not offer walk-in access to visitors.
